1. Introduction

This website is owned and operated by Graduation Photography. At the request of the University, Graduation Photography provides access to the University Portal and related services for students. These Terms and Conditions outline the relationship between Graduation Photography and students using these services.

By accessing the University Portal and utilizing its services, you confirm that:

• You are authorized by the University to use these services.
• You have read and understood these Terms and agree to be bound by them.
• All information provided for the use of these services is accurate, up to date, and complete.

If you do not agree to these Terms, you must discontinue the use of the University Portal and its services.

We reserve the right to update these Terms at any time. Any amendments will be posted on the University Portal and take immediate effect unless stated otherwise. It is your responsibility to review these Terms periodically. Continued use of the services constitutes acceptance of any modifications.

2. Scope of Services

Graduation Photography provides the following services to students, subject to University approval and service-level agreements:

Graduation Portal

• Studio portrait photography
• Stage photography
• Regalia hire and purchase
• Ticketing services
• Framing services
• Graduation merchandise and memorabilia

Graduation Photography reserves the right to modify service pricing at its discretion. Notification of price changes will be sent to your registered email address and will take effect immediately unless otherwise specified. If you do not agree with these changes, you may choose not to use the services.

3. Data Retention and Security

Personal data obtain through graduation portal is retained until thirty (30) days after the Graduation Photography. After this period, all personal data is permanently removed from our servers and the world wide web.

We implement security measures to protect personal data, but we are not liable for breaches beyond our reasonable control.

To access certain services, you may be required to provide your Student ID and/or date of birth. This information must be kept confidential. If you suspect unauthorized access, notify us immediately. Graduation Photography is not responsible for any loss resulting from the misuse of your credentials.

4. Use of the University Portal

Graduation Photography grants students a non-exclusive, non-transferable right to use the University Portal for booking graduation-related services. The University is responsible for updating key information such as:

• Ceremony dates and times
• Event venue details
• Ticket release schedules
• Payment methods
• Refund policies
• Purchase limits on tickets and memorabilia

While we strive to maintain portal availability, temporary interruptions may occur due to maintenance or other factors. Graduation Photography is not liable for any disruptions or restrictions.

5. Ticketing, Photography, and Regalia Services

• Ticketing services are subject to University policies. All ticket sales are final unless otherwise specified. Errors in pricing may result in ticket cancellations and refunds at the University’s request.
• By using photography, regalia, and memorabilia services, you agree to follow the booking and collection procedures outlined on the University Portal.
• Graduation Photography may subcontract services to third parties while ensuring professional standards are upheld.
• All online payments for services are subject to clause 7.

6. Cancellations and Postponements

In cases of event cancellations or postponements, Graduation Photography may assist the University with refunds if applicable.

7. Payment

• All payments are processed through SecurePay, a third-party payment provider STRIPE, Paypal, ANZ eGate
• Graduation Photography is not responsible for any issues arising from third-party payment processing.
• All prices include GST unless stated otherwise, and invoices will be provided upon successful payment.

8. Prohibited Conduct

You agree not to:

• Impersonate another individual or falsify personal information.
• Disrupt the functionality of the University Portal.
• Use automated means to collect data from the portal.
• Engage in fraudulent activities related to ticketing or services.

Violations may result in service termination without prior notice.

9. Termination of Services

Graduation Photography reserves the right to terminate access to services under the following conditions:

• Breach of these Terms.
• Fraudulent activity.
• Non-payment of fees.
• Providing false or insufficient information.
• Termination may also occur at Graduation Photography’s discretion with 30 days’ notice.

10. Intellectual Property

• All University / College content remains the property of the University.
• Graduation Photography retains ownership of its proprietary content, including website designs, graphics, and service materials.
• Unauthorized reproduction or distribution of content is prohibited.

11. Liability Disclaimer

• Graduation Photography excludes all warranties not expressly stated in these Terms.
• We are not liable for any indirect, incidental, or consequential damages related to the use of the University Portal or services.
• Your use of third-party services is at your own risk.

12. Privacy

By accepting these Terms, you also agree to the terms of our Privacy Policy, which governs the collection and use of personal information.

13. General Provisions

• These Terms are governed by the laws of New South Wales, Australia. Any disputes will be handled in NSW’s courts.
• If any provision is deemed invalid, the remaining Terms shall remain in effect.
• Force majeure events, such as natural disasters or system failures, do not constitute a breach of these Terms.
• Graduation Photography may assign its rights and obligations without prior notice.

These Terms constitute the entire agreement between you and Graduation Photography, superseding any previous agreements or understandings.
